Supreme Court has left the answer to this question up to the individual states. The majority of states, to date, have answered no; however, several states, most notably California and New Jersey, have answered yes. What is the basis for each States decision and how do these decisions affect the shopping center industry? Shopping Centers Organizations In order to understand how the ourts decisions affect the shopping center industry, we must first understand what a shopping center is and who the organizations are. As referred to in the two most notable court cases, Pruneyard v. Robins (Pruneyard) and NJ Coalition Against War in the Middle East et al. v. J. M. B. Realty Corp. et al. (JMB), a shopping center is defined as one that is between 300,000 square feet and 1,000,000 square feet in size and includes at least one large, over 100,000 square feet department store. During the 1990s, regional shopping centers have given way to super regional shopping centers. Super regional shopping centers are over 1,000,000 square feet in size and usually have four or more large department stores. For comparison in Arlington, Texas, The Parks at Arlington Mall and Six Flags Mall would be considered super regional malls while Festival Marketplace Mall would be considered a regional mall. The organizations that were involved in Pruneyard and JMB consisted of peaceful political activists who were protesting Zionism and the Gulf War, respectively. As far as a shopping center is concerned, anyone not associated with operating the center i. e. , employees, contractors, etc. , or etailers/merchants would be considered a potential customer or part of an organization, depending on if their reason for coming to the mall was to shop. The shopping center, of course, wants everyone to be a customer since their primary business is commercial in nature. First Amendment The First Amendment to the U. S. Constitution reads, Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or the press; or the right of people peaceably to assemble, and to petition the government for a redress of grievances. (Amendment I, 1) While this powerful amendment has very broad implications, it also has limitations. The U. S. Supreme Court has held that the Federal Constitution and its accompanying amendments give no general right to free speech in shopping centers since the centers course of business is notstate action. State actions are those actions taken by local government entities or public schools. This limitation is what forces the U. S. Supreme Court to leave the decision of free speech in shopping centers up to the individual states, their state constitutions and police powers. Evolution of Shopping Centers It has been argued, and sometimes accepted, that todays regional shopping center has taken the place of yesterdays downtown business district. From 1972 to 1992 the number of regional and super regional malls in the nation increased by roughly 800% (National Research Bureau 1). The reason for this phenomenal increase is the migration of residents from the city to the suburbs and the accompanying relocation of retail from downtown to the burbs. Shopping centers, by design, have made themselves one-stop destinations. Food, entertainment, apparel and other consumer goods are centralized in a limate-controlled environment. The downtown business district of old once afforded social and political organizations access to the masses. There is no question that the downtown streets and sidewalks were, and still are, public property. To make the distinction between a public downtown and private shopping center more confusing, it is not uncommon for a mall to have a U. S. Post Office as a rent paying merchant, or a police substation in a vacant space. Additionally, it is standard procedure to hire off-duty police officers to supplement mall security guards and even on-duty police officers, although much ess frequently. Another blurring of the distinction between public and private property is when a private mall developer uses some public funds to construct the mall or its infrastructure. State courts, so far, have ruled that the use of public funds does not convert a private mall into public property. (Mall of America, 1). Todays shopping centers provide social and political organizations an ideal place to interact with thousands of people on a daily basis. Shopping centers spend a great deal of money to entice people to come to the mall. Why doesnt the mall allow someone to demonstrate every day and whats wrong with having two opposing groups demonstrating at the same time? Is it too burdensome to require organizations to provide insurance as a precondition to using mall property? If not, than what dollar limit of insurance is sufficient to protect the malls best interest? Answers to these questions must be applied to all demonstrations uniformly and without bias. Even when a shopping center isnt required by law to allow demonstrations, they still should have a written plan to deal with demonstrators requests. During the mid-1990s it was common practice for a malls community access policy to be as follows: no non-retail related activities on mall property. This meant no Boy or Girl Scouts and no Salvation Army. It also meant a lot of very unhappy and influential organizations. As a mall manager who had to enforce such a policy, explaining the policy in the following way soothed many people over. If the mall allows the Boy Scouts to use mall property, than it must also allow the Ku Klux Klan in or face a discrimination lawsuit by them. Rather than face a possible lawsuit, everyone would be denied the use of the mall, except for shoppers. With the proliferation of e-commerce, these access policies have been greatly eased. It is still important, however, that each mall have a standardized method of accepting and scheduling non-shopping activities within the mall. At Six Flags Mall for example, there is a community room that is available to all organizations for a nominal clean-up fee of $20. 00 per use. They use a standardized reservation form, which allocates the room on a first-come, first-served basis. The room is away from the main corridors of the mall and has its own, separate entrance. The only rules governing the room are no outside food or drink is allowed and no smoking is allowed. A certificate of insurance is required, or it can be waived if all participants sign a waiver and a hold harmless agreement. Each group is required to submit a sample of their performance. This sample is used to determine if the group is appropriate for the stage. Some groups have been denied use of the stage for the following reasons: too many members to fit n the stage, proposed music was too loud, or the act was not suitable for a family oriented business. Although each one of these denials are grounds for litigation, each of them has a solid, documented reason for being invoked. It may be especially challenging for young children with developmental delays or autism spectrum disorders. To learn, they have to sit still. To learn, they have to be able to attend to the teacher, listening and responding when asked. Attending is a learned behavior. Often parents teach it. They teach it when they expect their children to sit at the table during dinner. They teach it if they take their children to church and ask them to sit for all or part of a worship service. They teach it by reading out loud to their children. Research has shown that the most effective way to teach reading is called the lap method. Children sit in their parents laps and listen to them read, following their eyes and following the text as the pages are turned. Children with disabilities often have trouble attending. At age two or three they may not be able to sit for 10 or 15 minutes. They may be easily distracted, or, if they are on the autism spectrum, they may not understand what they should attend to. They lack joint attention, where typically developing infants follow their parents eyes to find out where they are looking. Before you can expect a toddler with disabilities to sit through a twenty minute circle time, you need to start with the basic skills. Sitting in One Place All children are socially motivated by one of three things: attention, desired objects or escape. Children are also motivated by preferred activities, sensory input, or food. These last three are primary reinforcers because they are intrinsically reinforcing. The others-attention, desired objects, or escapeare conditioned or secondary reinforcers since they are learned and connected with things that occur in typical academic settings. To teach small children to learn to sit, use individual instructional time to sit with the child with a preferred activity or reinforcer. It may be as simple as sitting for five minutes and having the child imitate what you do: Touch your nose. Good Job! Do this. Good job! Tangible rewards might be used on an irregular schedule: every 3 to 5 correct responses, give the child a skittle or a piece of fruit. After a while, the teachers praise will be enough to reinforce the behaviors you wanted. Building that reinforcement schedule, pairing your praise and preferred item, you will be able to start reinforcing the childs participation in a group. Sitting in Group Little Jose may sit for individual sessions but may wander during group: of course, an aide should return them to their seat. When Jose is successful at sitting during individual sessions, he needs to be rewarded for sitting for continuously longer periods. A token board is an effective way to reinforce good sitting: for every four tokens moved, Jose will earn a preferred activity or perhaps a preferred item. It might be most effective to actually take Jose to another part of the classroom after he has earned his tokens (for his 10 or 15 minutes of the group.) Teaching Groups to Attend There are several key ways to build whole group attention by the way in which group activities are conducted: Keep circle time short to start. Circle time should not be any longer than 15 minutes when you start but should grow to 30 after three or four months.Mix it up. Circle time should not just be quiet activities such as storybooks, but should include motion songs, dancing and motion games, and give different children opportunities to lead the group.Maximize participation: If you are putting the date on the calendar, have one child find the number, another child place the number and a third child count the number.Praise, praise, praise: Use praise not only to reward good behavior but also to teach it. The Edge Academy has been developed to meet the challenge of providing the best education and foundation for future personal development to students in Akron. I am happy about the time I spent there in observation, and I gained many memories in working with the children and staff. The Edge Academy represents a school that I would like to seek a career in because I believe it is possible to make a difference in children’s lives by being a good teacher in such an environment. This needs to be balanced against producing good quality products too. They are also need to differentiate itself and its products from other competitors. IKEA believes there is no compromise between being able to offer good quality products and low prices. c.Communication Communication or updates on their environmental activities with its consumers and stakeholders must be consistent and up to date. IKEA produces publications in print and online (for example ‘People and the Environment’) and carries out major TV and radio campaigns to enable the business to communicate with different target audiences. Threats If a company is aware of possible external threats, it can plan to counteract them. By generating new ideas, IKEA can use a particular strength to defend against threats in the market. IKEA’s marketing strategy starts with their business concept as stated in IKEA’s vision statement: The IKEA vision is to create a better everyday life for the many people. We make this possible by  offering a wide range of well-designed, functional home furnishing product at prices so low that as many people as possible can afford them. This standardized approach provides operational advantages besides some disadvantages due to the different markets. Based on the marketing mix which starts with product strategy, product covers more than the physical goods that a company wants to sell. It is the goods & service combination that a company offers to the target market. Thus, IKEA offers a whole range of product with the pricing which supposed to be the same (95%) with very small adaptations for all countries and in all stores worldwide. The pricing of products are comparatively low to what the consumers can find in a competing store. The basic aim of IKEA is to deliver high value at a low price. IKEA has been cutting price in most of the countries. IKEA is also source it’s products from various companies all over the world rather than a small number of suppliers like many of the retailers do. IKEA has 1,300 suppliers from 53 countries, who can supply products as per local taste based on their needs. Most of the IKEA stores are placed out of city centre, out of town location due to a lower land cost and traffic access. Exceptional for UK stores (Coventry – 2007 & Southampton – 2009) located in city centre as a response to UK government restrictions blocking retail establishment outside city centers. It is a seven floors store with a different flow compare to other IKEA stores. Normally the stores will be 2 floors with a car parking availability and also comes with restaurants. The restaurants sell foods according to the local taste and also it opens daily before the rest of the stores. Example in Canada, breakfast includes eggs, sausage, and hash browns and various add-ons like bacon and pancakes at additional costs. In the United States, the local variation serves scrambled eggs, bacon, country potatoes and choice of Swedish pancakes or French toast sticks. The selling environment and service of IKEA stores are also adjusted to fit with local taste. Example like DIY concept is fully accepted by Sweden and UK where the consumers believe that’s the price they pay for the low prices products. Whereby in China, DIY concept is new to them because of the cheap labor and the prices are also not perceived as generally low. Q1.1What else could it be doing? 1.Developing competitive advantage – because IKEA has a low cost structure, they should be able to expand online market easily without incurring too much additional costs. IKEA also should look at an expansion to the West Coast, particularly California. Also, expansion into regions with enough people to sustain a store of their size. 2.Developing a strategic focus – going online is not only reaching potential customers in less populated area, it is also will help customers to catch up with competitors. Besides that, younger people (Gen Y) willing to buy online more compare to the older people. Question 2 – IKEA has essentially changed the way people shop for furniture. Factors that encourage customer’s choice of visit to IKEA – Pros i.Social motives for the customer – the shoppers go in group since the outlet is huge and it will take time to shop. Also the location is far from city. It’s a kind of short trip instead of shop-visit which consume a lot of time and they prefer to go in a group (friends or family). ii.Availability of other services and amenities – Restaurants (food and beverages) and baby-sitting services within the stores which gives a greater convenient to all customer. Parking is also not an issue since most of the stores located far from the city. iii.Information availability – online info is more useful. Customers can  surf online catalogues in various languages for inspiration and planning purpose before go to the store. This will also help them to catch up with their competitors. Younger generation will be also attracted with this online concept because they are the IT savvy generation compare to the older generation who is still a little â€Å"doubt† about buying online. iv.Access – Operating hours are good. Long hours on weekend very helpful for those customers work odd hours and also busy on weekdays. v.Speed of delivery – no waiting time as they go and pick up their products. Less store assistants and the routes are very long also make customers not really prefer to shop in IKEA. If you’re a handyman, or someone experienced with tools, it is fine. But for the normal men or even women, assembling some pieces might be slightly difficult. Passive Resistance as a Powerful Tool for Social and Political Change Passive resistance, simply defined as â€Å"peaceful resistance by fasting or refusing to cooperate,† (hyper-dictionary) is a complex issue, and potent tool to attain a means through absolutely zero violence. As Martin Luther King Jr. and Gandhi, have argued, passive resistance is a noble means to a peaceful end, in which only the followers of a movement risk themselves and bring no harm to those whom they oppose. â€Å"Passive resistance,† according to Mahatma Gandhi, â€Å"is an all sided sword; it can be used anyhow; it blesses him who uses it and him against whom it is used. Without drawing a drop of blood it produces far-reaching results.
